How long does it take to change a passport after marriage registration and how to do it correctly?

The Family Code of the Russian Federation has article 32. It regulates formal family relations, that is, the article states that after marriage registration both spouses have the right to change their last name or leave the same. In Russia, there is a Decree of the Government of the Russian Federation of July 8, 1997 N 828 (ed. November 18, 2016) “On the approval of the Regulations on the passport of a citizen of the Russian Federation, sample of the form and description of a passport of a citizen of the Russian Federation”. This document regulates the terms for issuing a new passport. Thus, a new passport will be ready at the place of residence no more than in 10 days, and not at the place of residence, for example, at the place of residence - no later than 30 days from the date of acceptance of the documents.

After the marriage is registered with the citizen who changed his name, there is a thirty-day period to submit the relevant documents for the change. But there is a nuance. The fact is that on the day of marriage registration, the name of the spouse will already be changed, and in the passport of the person who changed his name, the registry office staff will be stamped with the date of registration. In this regard, a passport with the current name is invalid and can not serve as an identity document.

Referring to the same Resolution “On Approval of the Regulations on the Passport of a Citizen of the Russian Federation ...”, documents for the replacement of a passport must be submitted no later than thirty days from the date of marriage registration.

If the documents were not submitted within thirty days, a citizen with a new surname will be fined from 2 thousand to 3 thousand rubles, and living with an incorrect passport in Moscow and St. Petersburg is punishable by a fine from 3 thousand to 5 thousand rubles.

A citizen can avoid administrative liability in two cases:

• if the submission of documents is delayed by no more than 7 working days;
• if there is evidence that caused the delayed treatment.

If the citizen does not repay the fine issued to him, you can wait for a stricter punishment, for example, an arrest for 15 days, an increase in the amount of the fine by 2 times, or an attraction to 50 hours of community service. These penalties are applicable for 2 years from the date of late payment.

In addition, due to the lack of a passport replacement or late payment of a fine, accounts may be arrested or a ban imposed on leaving the country.

As with any other ID card replacement, The institution provides the necessary list of documents.

• Application for replacement of the passport of the established form (form No 1P). The application must already have a new surname.
• Old passport, which is now subject to replacement.
• Two photos of the established size 35x45 mm. If you need a temporary ID, then pass 3 photos.
• Payment receipt of state duty or payment receipt details.
• Documents required for marks in the new passport spouse. Military registration documents, birth certificates of children under 14 years old.

For a personal visit, you can ask for a temporary ID, which will include your information, a number will be awarded, and the employee will paste your photo and indicate the date until which this certificate will be valid.

If you are submitting documents through the Single Portal of State and Municipal Services, you will be required to appear in person only to receive a passport, taking with you the original documents.

In addition to the identity of the Russian Federation, a citizen who changed his name must also replace other documents, including a passport.

Of course, the issue with a foreign passport is not as strict as with the all-Russian or, for example, with the rights. A spouse who changed his or her last name may not change an international passport until the expiration date, if there are no planned trips to visa countries, the main condition in all forms is to indicate that this is a maiden name. Cases with countries of the European Union or other countries where the order of entry is tightened, more difficult. For example, when applying for a visa, you attach a copy of the documents of the RF passport, and if the data diverges, then the documents will not be accepted.
